General Terms

These General Terms and Conditions are intended to establish the terms and conditions governing the provision of services by the company ALrightAzores, Unipessoal Lda, with registered office at Quinta de Nossa Senhora de Monserrate, Galera 9560-206 Água de Pau, registered at the Commercial Registry Office of Ponta Delgada, with corporate taxpayer number 515 858 021.

  1. These General Conditions govern the terms under which services are offered to clients. Any Specific Conditions for a given service shall prevail over these Conditions, and any other terms expressly agreed in writing between ALrightAzores, Unipessoal Lda and the client shall prevail over both sets of Conditions. By purchasing a service, the client accepts all the terms and conditions established.
  2. Payment terms may vary according to the service provided. In the absence of specific conditions, the general conditions apply, under which the client must pay 50% of the total accommodation price at the time of booking and the remaining balance 14 days before the check-in date.
    1. If the booking is made 14 or fewer days before check-in, the full price shall be paid at the time of booking.
    2. A booking may be cancelled by ALrightAzores, Unipessoal Lda if there are payments not made by the client under the conditions described above.
  3. Cancellation by the client works as follows:
    1. If cancellation is communicated less than 14 days before the check-in date, there shall be no refund. Furthermore, once the stay has begun, the client is not entitled to any refund for unused services.
    2. If cancellation is communicated 14 or more days before the check-in date, the amount already paid shall be refunded in full, less any transaction costs that must be borne by ALrightAzores, Unipessoal Lda.
  4. Value Added Tax is included in the price of the service.
  5. Whenever there are justifiable reasons, the accommodation unit may be replaced by another of equal or higher category, by written agreement with the client and without any increase in the price paid by the client.
  6. If unforeseen circumstances oblige ALrightAzores, Unipessoal Lda to cancel a booking without the Client having breached its duties, or if the client does not accept a change to their booking under the provisions of clause 5 of these Conditions, the Client shall be entitled to a full refund of the amounts paid.
  7. The stay of a child up to 1 year of age is not charged, provided the child stays in the same accommodation unit as the adults responsible for them and does not cause the unit's capacity to be exceeded. The stay of extra guests (any person aged 2 or older beyond the unit's capacity) is charged according to the price shown on the booking form. The client must, however, always inform ALrightAzores, Unipessoal Lda about the inclusion of children in their booking. The acceptance of an extra person is subject to the number of cots and/or extra beds available, as well as the space available in each accommodation unit.
    1. It is the client's sole responsibility to provide information on the number of people (adults and children) who will occupy the accommodation unit. If more people present themselves than those booked, entry may be refused without any refund.
  8. Without prejudice to the specific information for each advertised unit, the standard check-in time is 16:00 and the check-out time is 11:00. Exceptions may be permitted, provided they have no effect on other bookings and/or on the cleaning of the accommodation unit.
  9. Meals – ALrightAzores, Unipessoal Lda offers accommodation under the Local Accommodation (Alojamento Local) regime and does not provide any meals.
  10. Pets are not accepted, except for guide dogs.
  11. The client is obliged to indemnify ALrightAzores, Unipessoal Lda for any damage caused to the accommodation unit and/or its supporting facilities, as well as all damages arising from the breach of the duties set out in these general conditions, including in particular lawyers' fees and court costs.
  12. Before and after check-in, the client may pay for services by bank transfer, PayPal, Credit Card, Multibanco Reference, or MBWay. Payments in cash or by cheque are not accepted.
  13. ALrightAzores, Unipessoal Lda reserves the right to amend these General Conditions at any time.
  14. In the event of a consumer dispute, the consumer may resort to the European Online Dispute Resolution Platform, available at http://ec.europa.eu/consumers/odr, or to the alternative consumer dispute resolution entities.
  15. For the judicial resolution of all disputes arising from this contract, namely those relating to its interpretation, performance, breach, invalidity, termination, or reduction, where it has not been possible to reach an amicable solution, the jurisdiction of the District (Comarca) of Ponta Delgada is stipulated, with express waiver of any other.
